Lawyer Marco Austin reported that the National Lottery of Beneficence (LNB) has illegally maintained the dismissal of nine social workers who worked at the institution. These dismissals took place in January of this year, and so far, the Lottery has not responded to requests to reverse the decision. Austin, representing the affected, highlighted that the reconsideration appeal should suspend the dismissal, but the Lottery has failed to comply with this procedure.
The regulations establish that when a reconsideration appeal is filed, the dismissal decision must be suspended until the entity resolves the case. However, the nine social workers remain dismissed, and the Lottery has not provided a clear response regarding this. Austin expressed frustration over the lack of access to the files and the institution's failure to cooperate to clarify the situation.
The lawyer criticized that, despite their attempts to obtain information from the Lottery, they have faced resistance and obstruction. The lack of access to the files hinders the defense of the workers' rights, as it prevents knowing the arguments used to justify the dismissals. Austin emphasized that the dismissals were carried out without respecting due process and without presenting evidence to support the separation of the employees from their positions.
Due to the lack of responses from the National Lottery, Austin announced that they would resort to judicial instances to defend the rights of the affected workers. He emphasized that they would seek justice in higher courts, including the possibility of bringing the case to the Supreme Court if necessary. The lawyer stressed the importance of justice intervening to restore the rights of the workers and allow them to return to their jobs.
