The Attorney General, Azael Samaniego Ivaldy, admitted the charges against two of those involved (Porcell and López Pérez) for the alleged commission of crimes against collective security in the form of illicit association, against the administration of justice for the simulation of punishable facts and slander in judicial proceedings, and against the legal personality of the State.
Lawyer Roiz Navarro went yesterday, Monday, to the primary attention prosecutor's office of the Public Ministry (MP) to be notified of the acceptance of the complaint filed against former President Juan Carlos Varela, the former Attorney General Kenia Porcell, and the former director of the National Security Council, Rolando López Pérez.
Samaniego Ivaldy did not include former President Juan Carlos Varela in the complaint because he is protected by the immunity granted by the Constitution as a deputy of the Central American Parliament (Parlacen); therefore, he can only be investigated and judged by the Supreme Court of Justice (CSJ), but he clarified that if findings are found in the investigation that imply his guilt, they will be referred to the competent authorities for their investigation.
According to the prosecutor's office, the process is in its initial phase and the necessary procedures will be carried out to determine the existence or not of the punishable fact and the responsibility of those involved.
“This office is prevented from admitting Mr. Juan Carlos Varela as a passive procedural subject in the present case, without prejudice to what has been stated regarding the eventual future referral of proceedings, in case elements arise that merit it,” the resolution states.
Navarro, representing Germán Chanis Aguilar, indicated that he does not rule out that the MP will find grounds for conviction that link the former head of state so that the CSJ does what corresponds to it.
He added that it is “evident” the interference that the Executive had in the judicial system, so this investigation would give rise to the “nullity” of several sentences.
