The company argues that the commission violated the tender specifications by not taking its arguments into account. Istmo Green also insists that its disqualification is unfounded, as it provided all the required information. The consortium, composed of Panamanian and Colombian companies, demands the appointment of a new commission to review the bids. In response, Istmo Green's lawyers state that the certification they submitted fully confirms their technical experience, as it includes all the necessary data: the contracting entity's name, the contract's object, the scope of services, the operational volume, and the execution period, along with the formal validation of the issuing entity. They believe the tender specifications did not explicitly require the use of a specific form to prove experience. This new protest further delays the already postponed process of contracting new waste management companies. This is the third complaint from Istmo Green, disputing a commission's decision that did not fully recognize its compliance with the requirements for tender lot No. 3. If the complaint is accepted, the tender will be suspended pending a final ruling from the regulatory body. Lot No. 3 corresponds to Zone 4 of the capital, which includes the districts of Tocumen, Pedregal, Mañanitas, Juan Díaz, Las Garzas, San Martín, 24 de Diciembre, and Pacora.
