
The Authority for Consumer Protection and Competition Defense (Acodeco) denied the claims made by a union regarding the issuance of a report related to monopolistic practices by the company ENSA, stating that no final investigation report has been issued on this matter.
In this regard, Acodeco explained that the investigation process is carried out in three stages: the preliminary, the formal, and the judicial. In the preliminary stage, it is determined whether the allegations warrant an investigation, followed by the formal stage where evidence is gathered and a final report is issued that recommends whether or not to initiate judicial proceedings for monopolistic practices. Finally, in the judicial stage, the case is presented before the Judicial Body for evaluation.
Currently, Acodeco is in the formal investigation phase, led by its National Directorate of Free Competition. It was emphasized that so far no recommendations or definitive conclusions have been made regarding the case, as the confidentiality of the information must be respected during such investigations.
Acodeco reiterated its commitment to the development of a fair and competitive market, urging all parties involved to act sensibly and responsibly to maintain the legality of the ongoing process. The entity emphasized its actions in accordance with the law and the importance of following established procedures to investigate alleged monopolistic practices.
