A legal resource has been presented for seven social workers from Veraguas Province, wrongfully dismissed by the National Lottery Director. The law firm argues due process was not followed.


Reconsideration Filed for Dismissed Social Workers

Seven social workers from the province of Veraguas have filed a reconsideration request on their behalf, as they were unjustly dismissed by the director of the National Lottery of Charity. The request was filed by the firm Austin & Associates and argues that due process was not followed in this case.

In the presented argument, it is noted that the social workers were subjected to a supposed administrative investigation and were dismissed, some of them having immunity due to their own disabilities or those of their children. The law firm has requested an immediate suspension of this action and a reconsideration of the decision. If this request is not addressed, the cases will be raised to the board of directors of the Lottery and, if necessary, will be presented in the Third Chamber of the Supreme Court of Justice with a full jurisdiction appeal on behalf of the social workers from the areas of Santiago and SonĂ¡ in Veraguas.

The law firm has emphasized that, according to the Administrative Career Law, social workers in public institutions enjoy stability contingent on their professional competence, governed by the Merit System and Scale, using the Administrative Career Law as a supplementary source. The career of the Social Worker is protected and regulated through a Special Law, thus the dismissal of these public servants does not comply with that regulation.

This situation has generated a debate regarding the protection of the labor rights of social workers and the importance of respecting established processes to guarantee stability and the fulfillment of their functions for the benefit of the community.
