Lawyer Luis Fuentes Montenegro expressed his concern and rejection regarding the actions of the Fifth Circuit Civil Court of the First Judicial Circuit of Panama in the process involving the company Eternity Shine, S.A. and P.H. In a situation where a lower court does not comply with a ruling from the Supreme Court, Fuentes Montenegro questioned the trust citizens can have that their rights will be respected, affecting not only the parties involved but the judicial system as a whole.

"Fuentes Montenegro called on the Supreme Court of Justice and the competent authorities to investigate this situation and take necessary measures, whether through criminal actions, constitutional protections, or disciplinary processes, in order to restore the legal order and ensure respect for the rulings of the highest judicial authority," he emphasized.

Subsequently, the lawyer highlighted that the Eternity Shine case represents a serious violation of the Constitution and the institutions of the country by failing to comply with a definitive ruling from the Supreme Court of Justice. The disobedience of a lower court to a ruling from the Supreme Court constitutes, according to Fuentes Montenegro, a direct attack on legal security and democratic principles.

The lawyer mentioned that there are three legal avenues to address the court's refusal to comply with the ruling: the filing of a criminal complaint against the judge, the submission of a Constitutional Guarantee Amparo, or requesting the CSJ to issue a formal attention call and initiate disciplinary proceedings against the judge.

In conclusion, the Eternity Shine case has generated concern in the Panamanian judicial sphere and has awakened the need to guarantee respect for the decisions of the highest judicial authority, promoting concrete actions to restore legality and trust in the country's justice system.
