The Supreme Court of Justice of the Republic of Panama has declared unconstitutional the laws and acts related to the Concession Contract between the State and the Panama Ports Company, S.A. This decision was made during its ordinary session on January 29, 2026, after extensive deliberation and discussion of Entry No. 5 of January 16, 1997, its amendments, and the Act of Extension. Fulfilling its duty as the guardian of the Political Constitution, the court ruled that these provisions are unconstitutional. These laws pertain to the development, construction, operation, administration, and direction of container, Ro-Ro, passenger, bulk cargo, and general cargo terminals in the ports of Balboa and Cristóbal. This ruling follows two unconstitutionality claims: No. 119313-2025 and No. 17547-2025.
