Although several of the accused managed to close their cases through plea agreements, Chanis remains in custody without a final sentence, a different treatment that the defense describes as arbitrary and discriminatory. This scenario, according to the legal brief, reinforces the thesis that there was a selective use of the criminal justice system for political purposes. The legal action requests the investigation of possible organized crime, influence trafficking, illicit association, and crimes against the administration of justice. A criminal complaint admitted by the Public Prosecutor's Office has placed former President Juan Carlos Varela, former Prosecutor Kenia Porcell, and former head of the Security Council, Rolando López, alias 'Picuiro', under scrutiny for a supposed conspiracy from power to twist justice and fabricate criminal cases. The legal action was presented by lawyer Roiz Alberto Navarro on behalf of businessman Germán Eliecer Chanis, known as 'Fakir', who has been detained since January 2018 at La Mega Joya penitentiary. According to the document, the messages show direct coordination between Varela and then-Prosecutor Kenia Porcell to promote criminal investigations. Phrases such as 'How is Fakir doing?' or 'let's put pressure' are cited as proof of an alleged undue interference in the administration of justice, which, according to the defense, violates basic principles of the Rule of Law. The complaint directly points to file 10447, known as 'Operation 507'. The defense maintains that Chanis was a victim of political persecution and that his detention was the result of direct pressure from the Executive on the Public Prosecutor's Office. The heart of the complaint is the so-called 'Varela Leaks', leaked chats from the former president's cell phone whose authenticity was publicly recognized.
