The company Eternity Shine is facing an unusual judicial delay in its case against Megapolis Outlet, which has been unresolved for over 12 years despite a Supreme Court decision ordering the payment of the amounts owed. The ruling of Judge Mahiba Dixon of the Fifth Civil Court recently determined a payment to Eternity Shine below what is stipulated by law, leading the company to appeal to the First Superior Court.
The original process took more than a decade to be resolved by the Supreme Court, and the additional delay in the enforcement of the judgment has left the fulfillment of justice in suspense. Despite the instruction from the highest court in the country to make a full payment to the plaintiff company, the order has still not been complied with after two years, resulting in an appeal situation.
Judge Dixon's attitude has raised concerns in the judicial and business sectors, as some see an unjustified resistance to executing the final order. This raises questions about respect for the decisions of the Supreme Court and about possible legal tactics that might intentionally be delaying the process.
Eternity Shine's Secretary General, Eleonora Singh, has expressed her dissatisfaction with the sluggishness of the case and has sent a letter to the president of the Supreme Court, María Eugenia López, seeking assistance regarding the management of the case by Judge Mahiba Dixon. Despite fifteen years of waiting, the company has still not achieved justice and seen the execution of the judgment that would allow it to recover its property. As of October 2024, the case remains on appeal and the execution of the ruling is pending, raising doubts about the effectiveness and credibility of the judicial system in Panama.
