Former deputy Zulay Rodríguez Lu announced that she will file complaints against prosecutor Federico Andrés Ayú Prado Canals for ordering the dismissal of her complaint, filed in June 2023, against Annette Planells, Mauricio Valenzuela, and other members of the digital outlet Foco. The complaint alleged crimes against the inviolability of secrecy and the right to privacy, as well as against life and personal integrity in the form of psychological injuries.
Rodríguez Lu stated that the prosecutor has refused to investigate her case, "because that's where Nito falls, that's where Gaby falls, and that's where Foco falls." She alleged that the Council on Security during the "Nito" Cortizo administration provided the audio recordings of her private conversations with her husband to Planells' group.
Rodríguez Lu mentioned that she had even requested Prosecutor Ayú Prado to take a statement from Ismael Pittí, a member of the Council on Security, but was denied. Consequently, she had to request a hearing for the violation of her rights, and a guarantees judge ordered the prosecutor to interview Pittí.
"How did Foco have three unpublished audios that had never been made public?" she questioned, also a former presidential candidate. She emphasized that even the Penal Code establishes that you cannot replicate an audio (of private conversations), as it is illicit.
She stated that she will request a hearing to petition for the case file to be reopened for analysis by another prosecutor, and will additionally proceed to file an administrative complaint and a criminal complaint against the official from the Section of Crimes Against Freedom and Honor of the Public Ministry.
