Court Declares Electronic Invoice Unconstitutional

The Court has declared unconstitutional the DGI's requirement for the use of electronic invoices for lawyers, architects, doctors, and engineers. This decision raises questions about future tax policies in Panama.

Court Declares Electronic Invoice Unconstitutional

The Supreme Court of Justice has declared the mandatory use of electronic invoicing unconstitutional for lawyers, architects, doctors, and engineers in Panama. Despite this, the General Directorate of Revenue (DGI) continues to require these professionals to use electronic invoicing.

According to the court's decision, the regulations imposing the obligation of electronic invoicing on these sectors violated the Constitution of the country. However, the DGI remains firm in its position and continues to request that lawyers, architects, doctors, and engineers use this method for their transactions.

This situation has generated controversy among the affected professionals and the DGI, as the Supreme Court has ruled against the mandatory use of electronic invoicing for these groups, yet the tax institution continues to enforce its requirement.

In this regard, the affected parties have expressed their concern and have requested that the Supreme Court of Justice's decision be respected. They believe that the imposition of electronic invoicing goes against their rights and hope that the situation will be resolved in favor of their position.
