Former congresswoman Zulay Rodríguez Lu has announced her intention to take legal action against prosecutor Federico Andrés Ayú Prado Canals for ordering the dismissal of her complaint. The complaint, filed in June 2023, accused Annette Planells, Mauricio Valenzuela, and other members of the digital outlet Foco of crimes against the inviolability of secrecy and the right to privacy, as well as against life and personal integrity in the form of psychological injuries. Rodríguez Lu asserts that the prosecutor has refused to investigate the case, as doing so would lead to the downfall of 'Nito,' 'Gaby,' and the individuals at Foco. She pointed out that the National Security Council, during President 'Nito' Cortizo's term, provided the Planells group with audio recordings of her private conversations with her husband. The prosecutor's decision to close the case was based on the argument that the release of the audios did not constitute an 'improper disclosure of an electronic document consisting of a recording.' Rodríguez Lu called this argument absurd and stated that the prosecutor is protecting Planells and Foco. She questioned how Foco came to possess three unpublished audio recordings. The former congresswoman emphasized that she had requested the prosecutor to take a statement from Ismael Pittí, a member of the National Security Council, but was refused. As a result, she had to request a hearing regarding the violation of her rights, during which a judge ordered the prosecutor to interview Pittí. Rodríguez Lu also stated that she will file an administrative complaint and a criminal lawsuit against the official in the Public Prosecutor’s Office’s Crimes Against Liberty and Honor Section. She will seek a hearing to petition for the case file to be reopened for review by another prosecutor. 'The wiretapper! Only the National Security Council could have given them that information,' she stated.
